US Judge Orders Release of Abrego Garcia from ICE Detention
A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks lawful basis.
"Since his return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.
The situation originates in a erroneous removal to El Salvador earlier this year, which the government later admitted was an mistake. Following his return to the United States to answer alien smuggling charges, he was detained in immigration detention.
In her order, the judge noted that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
